By using this web site, downloading from this site or using products or services made available through this site, you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site, downloading from this site or using products or services made available through this site. The materials contained in this website are protected by applicable copyright and trade mark law. In this document the terms - website, site - refer to the website, the term - game - refer to the game Dungeon Colony available for download on the website. The game is made up of a Launch Program, which searches the website for a new version of the game when executed. New versions automatically download the newest game files. The Launch Program and the Game files combined are also referred to as 'game'.

If you do not agree with this terms document, do not purchase any product or service with us. Downloading and playing the game under any or no license is always 'as is' and may change at any time. You may not purchase our services or product from any other place but our website, with the exception of approved third parties. It is possible that the game is declared complete or the development be discontinued at any time. Depending on the current development status you may have to purchase a license or request a free license. In case you purchase the game, a license, or purchase the game or license by setting your own price in any such case all purchases are always non-refundable.

If you download and play the free alpha, your game data may be uploaded to our server in order to aid game balancing and other game design decisions. If you decide to buy the game and support our efforts to finish it, we want thank you for your support: Game updates are not included in purchase of license or registration and are distributed as additional complimentary material. Upon release of the game you will receive a full game license sent to an address in your contact information collected at your purchase transaction. Additional perks may be announced to you via email. Your purchase does not guarantee that the game will look like, play like or have the same experience as currently described by its creators. The Scope, Concepts, Design and Content of the game can change during its development and after its release. You are not permitted to redistribute the game and any other content or resources that were created by us under any circumstances. Access limitations and access duration per license may vary and can change at any time. You are granted access to online game save functionality if you unlock a passcode. You must register to unlock the passcode which can be found on the profile page. During Alpha, game saves will be stored on our game server so that developers can access the data to aid in the development of the game. We keep the right to use every user's passcode in order to load user game saves. This includes the right to view and modify game data. Generally this will be used to debug any issues that may occur in the development process such as bugs generated by certain game play or game setup from an individual player. You may not resell your account and any licenses associated with your account and you are not permitted to use our product/services commercially.

The same terms described in this document also apply to updates. By registering, you are permitted to download, install and play the game, but do so at your own risk. We are not liable if the game starter or the actual game source causes any problems on the device you installed the game on or causes any other problem or harm to you. This includes connecting to and/or downloading new game updates from the website. You may take screenshots and record videos of the game and use them for non-commercial reasons. During game development, any suggestions received from you or any group/entity are assumed to be offered free of charge unless agreed upon before any suggestions were made. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site. We reserve the right to change this agreement at any time with or without notice, with immediate and/or retroactive effect.

Privacy Policy

When you register on and/or purchase from us any game license, pre-purchase and/or set your own price to purchase the game or service we will collect some information about you to identify you as an account holder. Once you purchase your account, we also create an account that allows you to login and play Dungeon Colony. The account created uses the same email address as username and identification in order to link your purchase to your Dungeon Colony account. You may request to have your username changed, given availablity and approval by us. Please agree that we store such information about you in case of purchase or registration with us. Its main purpose is to complete the agreement towards you and establish a link allowing you to retrieve your account info in case you forget. Generally, accounts which have been inactive for over 5 years may be deleted from our data store, which includes the removal of any remaining licenses and other user/game data. However, 5 years is a not a hard limit and can change or any time. Our goal is clean data. You can request to have your account removed or information corrected via the email address associated with your account. When the game is launched, information about application usage is sent to server. Such data include datetime stamps, gameID and sessionIDs. This data is used to determine application usage for various analytical algorithms. When an application error occurs, the stack trace of the error is sent to the server along with the version number and the userID. You agree that such information as listed in this document is collected and you agree that you may be contacted with regards to any of this information. We respect your privacy and an example to contacting you would be to try to resolve and find the solution to a bug that you experienced.
